The Lessee has fully inspected and acknowledges that the equipment is in good condition and repair (except as noted in the comments section of the delivery/pickup form).
The Lessee is responsible for the following:
To furnish a competent operator. Operators must have valid Canadian driver’s license.
To furnish an operator previously trained in forklift operation. (Forklift Only)
To ensure normal daily maintenance and checks are performed as indicated in the operator’s manual.
To inform the Lessor immediately of any equipment damage, failure or malfunction.
To use the equipment within its rated capacity.
To ensure the equipment is operated with a driver’s overhead guard and load back rest installed. (Forklift only)
If the Lessee is an incorporated company, an individual with signing authority must provide a personal guarantee for the rental. The Guarantor will assume the same responsibilities as the Lessor, as described in this agreement.
The following additional charges shall be charged to the credit card on file:
If the equipment is returned without a full tank of fuel, a fuel fee of $25 plus the number of litres required to fill the tank at the current price will be charged.
If the Lessee opts out of the cleaning fee and the equipment requires cleaning when returned, a cleaning fee will be charged at double the pre-rental amount.
Any part of the rented equipment that is missing upon return will be charged at cost.
If equipment use exceeds the hour limits below, an additional prorated hourly rental fee will be charged:
One day – 8 hours of use
Weekend – 16 hours of use
One week – 56 hours of use
Four weeks – 224 hours of use
Insurance coverage is offered at an additional charge, through a third-party insurer, for rentals of four weeks or less in duration. This insurance includes both liability and property insurance with respect to your rental. A copy of the detailed policy can be provided upon request.
If an insurance claim is required, the amount noted on the rental invoice will be charged to the credit card on file as a deductible. If the amount of the repair is less than the deductible, the Lessee will only be charged the amount of the repair.
B) Insurance does not include coverage for misuse or negligence of the equipment. In case of damage or liability due to misuse or negligence the Lessor can seek compensation in addition to the amount of the deductible noted in the rental invoice. The Lessee is responsible for returning rental items in the same condition in which they were received and is liable for the replacement cost of damaged or lost items.
If the offered insurance is not purchased, the Lessee shall furnish insurance for the term of the rental with the Lessor listed as an additional insured and as first loss payee. The Lesse shall assume and be responsible for the entire risk of loss or damage to the equipment from any and every cause whatsoever. No loss or damage to the equipment or any part thereof shall impair any obligation of the Lessee under this lease and shall continue in full force and effect. In the event of loss or damage of any kind whatsoever to the equipment the Lessee at the option of the Lessor shall:
A) replace the same in good repair, condition and working order; or
B) replace the same with like equipment in good repair, condition and working order, or
C) if the same is determined by the Lessor to be lost or stolen, destroyed or damaged beyond repair, the Lessee shall pay the Lessor therefore in cash the established new cost.
The said rental rate and charges shall not terminate until the Lessee has complied with the provisions herein contained.
As to the whole of the contract between the Lessee and the Lessor, the Lessee agrees to hold harmless and indemnify the Lessor for any and all losses that arise through this agreement, including but not limited to, legal expenses.
In the event of a dispute between the Lessee and Lessor, both parties agree that this contract will be governed by the Laws of Nova Scotia and that any dispute between the Lessee and Lessor will be brought before the Supreme Court of Nova Scotia.
The Lessor (Fort Equipment) shall be responsible for scheduled maintenance of the equipment as indicated in the operator’s manual.
The Lessor (Fort Equipment) shall also be responsible for completing any repairs that would normally be covered under the manufacturer’s warranty.
The Lessor shall have the right at any time during usual business hours to inspect the equipment and make any repairs thereto that the Lessee has failed to make and for that purpose to have access to the place where the equipment is located.
The Lessee shall make the equipment accessible and available at the time of pick up by the Lessor or rental charges shall continue until the equipment is accessible and available and the Lessor is so advised. A separate pick-up charge shall be made for each pick-up trip required.
Rentals include pickup/delivery after 12pm on the day prior to the start date and return by 12pm on the day after the end date, except:
A) Rentals that begin on Monday require pickup/delivery on Monday.
B) Rentals that end on Friday require drop-off/delivery on Friday.
If a rental unit is returned early, the Lessee will be issued a credit for half the value of the time remaining on the rental contract.
Daily rentals are not available on weekends. Rentals cannot begin on a Sunday.
Fort Equipment reserves the right to refuse to rent to a Lessee without explanation.
Prior to the start of a rental, Fort Equipment reserves the right to increase the posted rental rates for the Lessor if the application will cause greater than normal depreciation to the equipment.
By signing the online form, the Lessee acknowledges reading and receiving a copy of this rental agreement.
